What is the H2-A visa program?

The H2-A Visa.

The H2-A visa program allows U.S. employers who meet specific regulatory requirements to bring foreign workers to the United States to fill temporary agricultural jobs.

The H2-A visa program involves the following government offices:

  • State Workforce Agency (SWA)
  • Department of Labor (DOL)
  • U.S. Citizenship and Immigration Services (USCIS)
  • U.S. Department of State (DOS) at a U.S. Embassy or
  • Consulate abroad

To qualify for H2-A nonimmigrant classification, petitioners must establish that:

  •   Offer employment that is temporary or seasonal in nature.
  • Demonstrate that there are not enough U.S. workers who are able, willing, qualified, and available to perform the work.
  • Show that employing H-2A workers will not negatively impact the wages and working conditions of similarly employed U.S. workers.
  • Submit a valid temporary labor certification from the U.S. Department of Labor along with the H-2A petition.

What is the H2-B visa program?

The H2-B Visa.

The H-2B program allows U.S. employers or U.S. agents who meet specific regulatory requirements to bring foreign nationals to the United States to fill temporary nonagricultural jobs.

The H2-B visa program involves the following government offices:

  •   Department of Labor (DOL)
  • U.S. Citizenship and Immigration Services (USCIS)
  • U.S. Department of State (DOS) at a U.S. Embassy or Consulate abroad

To qualify for H2-B nonimmigrant classification, petitioners must establish that:

  • There are not enough U.S. workers who are able, willing, qualified, and available to do the temporary work.
  • Employing H-2B workers will not adversely affect the wages and working conditions of similarly employed U.S. workers. 
  • The need for the prospective worker’s services or labor is temporary, even if the underlying position is not inherently temporary ni nature.
  • A valid temporary labor certification from the U.S. Department of Labor (DOL) must be submitted with the H-2B petition.

What is the TN visa program?

The TN Visa.

The United States-Mexico-Canada Agreement (USMCA), formerly known as the North American Free Trade Agreement (NAFTA), created special economic and trade relationships for the United States, Canada, and Mexico. The TN nonimmigrant classification permits qualified Canadian and Mexican citizens to seek temporary entry into the United States to engage in business activities at a professional level.

The TN nonimmigrant classification involves the following goverment offices:

  

  • U.S. Department of State (DOS) at a U.S. Embassy or Consulate abroad


No DOL certification or USCIS petition is required for this purpose

  •   

To be eligible to work in the United States as a USMCA professional iunder the TN nonimmigrant classification the candidate meet the following conditions:


  • Be a citizen of Canada or Mexico;
  • Hold a profession listed under the USMCA agreement
  • Be offered a position in the United States that requires a USMCA professional;
  • Have a prearranged full-time or part-time job with a U.S. employer or entity
  • Posses the necessary qualifications to practice the profession in question.
